By proceeding with this transaction you agree to be bound by the following terms and conditions:



1. Interpretation


1.2 Customer or you means the customer placing this purchase order with MINISTRY OF EDUCATION.

1.3 Goods means the goods ordered by you from MINISTRY OF EDUCATION.

1.4 This Contract shall be governed and construed in accordance with the laws in force in the State of Queensland and the parties submit to the non-exclusive jurisdiction of the Courts of Queensland.


2. Agreement Between Parties


2.1 Upon ordering goods from MINISTRY OF EDUCATION you hereby agree to be bound by these Terms & Conditions and a binding Contract is created between you and MINISTRY OF EDUCATION upon such order being placed.

2.2 These terms and conditions contain the whole Agreement between the parties unless MINISTRY OF EDUCATION and the customer agree in writing that any other correspondence, discussions or documents shall form part of this agreement and the parties agree that all warranties implied under statute or the common law will not operate upon this Agreement.




(i) pending payment and subject to Clause 4 of this Agreement, deliver the goods ordered by the customer to the customer’s delivery address within a reasonable time;

(ii) ensure the goods are free from defects and that the goods perform their intended function.

3.2 A failure by MINISTRY OF EDUCATION to perform those obligations mentioned in Clause

3.1 of this Contract does not give the customer a right or cause of action at law against MINISTRY OF EDUCATION or a right to terminate this Contract.


4. Your Obligations

4.1 It is a condition of this Agreement that payment be made by you in respect of goods ordered from MINISTRY OF EDUCATION and proper payment details provided by you before proceeding with this transaction.

4.2 You acknowledge that MINISTRY OF EDUCATION reserves the right to refuse any order where it is apparent to MINISTRY OF EDUCATION that payment details provided by you are incorrect, improper or the subject of fraud.

4.3 You acknowledge payment is a condition precedent to shipment and MINISTRY OF EDUCATION reserves the right to refuse any order where it is apparent that payment of goods ordered by you cannot or is unable be processed.

4.4 Notwithstanding Clauses 4.1, 4.2 & 4.3 MINISTRY OF EDUCATION reserves the right to render tax invoice/s in respect of goods ordered by you in circumstances it so chooses and you hereby agree to pay any tax invoice rendered by MINISTRY OF EDUCATION by the due date for payment specified on the tax invoice.

4.5 If any tax invoice is not paid by the due date for payment, MINISTRY OF EDUCATION shall be entitled to charge interest on such amount as is outstanding from time to time at the rate of 1.5% per month.

4.6 Notwithstanding Clauses 4.4 & 4.5 the customer acknowledges it will remain liable to MINISTRY OF EDUCATION for the total price of the goods whether or not the goods have been shipped, delivered or a tax invoice rendered in respect of the goods so ordered.


5. Delivery

5.1 Upon receipt of payment by MINISTRY OF EDUCATION, risk in the goods passes to the customer unconditionally, whether or not the goods are specific, ascertained, unascertained or future goods at the time risk is deemed to pass.

5.2 In addition to but without limiting Clause 3 of this Contract, the customer hereby agrees MINISTRY OF EDUCATION will not be liable in any way, whether in any action in contract, negligence or other tortious action, arising out or as a result of damaged goods or delayed delivery reasonably related to any matter connected with shipment of the goods by MINISTRY OF EDUCATION to the customer.

5.3 The customer agrees to pay MINISTRY OF EDUCATION for all shipping and freight costs associated with delivery of the goods to the customer.


6. Variation

6.1 You hereby acknowledge upon receipt of any order placed by you, MINISTRY OF EDUCATION reserves the right to alter the character of the goods ordered prior to delivery as might reasonably be necessary taking into account the availability of the goods or any other matter beyond MINISTRY OF EDUCATION’S control.


7. Shipping and delivery policy

7.1 We deliver products Australia-wide through companies such as AUSTRALIA POST.

7.2 Orders are dispatched as soon as payment is cleared and will in most instances be delivered within 2-4 business days, depending on where you are located in Australia.

7.3 Shipping costs are calculated in the shopping cart and will be added to the order total before checkout.

7.4 All orders are shipped via regular post. The customer should contact MINISTRY OF EDUCATION prior to checkout if they wish to arrange an express or alternative shipping method.


8. Pricing policy

8.1 All of our prices are in Australian dollars (AUD).

8.2 Product prices may be subject to update when price changes are received from our suppliers.


9. Customer service policy

9.1 MINISTRY OF EDUCATION is committed to providing exceptional customer service and quality products.

9.2 In the event that an ordered item is not available or we are unable to fulfil your order we will notify you as soon as we have knowledge of this, to arrange an agreeable alternative item, a backorder or a full refund.


10. Refund/Return policy

10.1 Please choose carefully. We do not normally give refunds if you simply change your mind or make a wrong decision.

10.2 You can choose between exchange or store credit coupon where goods are damaged or have been wrongly described.

10.3 MINISTRY OF EDUCATION will not be responsible for, or refund any freight charges to a customer for any return parts regardless of reason for return.

10.4 Should a product arrive to the intended addressee damaged, the customer is responsible for notifying MINISTRY OF EDUCATION immediately via email.

10.5 Damaged items are to be returned to MINISTRY OF EDUCATION no longer than 30 days after item’s original shipping date.

10.6 Following communication process for damaged goods noted in Clause 10.4, MINISTRY OF EDUCATION will negotiate a method of return of damaged goods and notify customer.


11. Positive guarantee

11.1 MINISTRY OF EDUCATION guarantees its products are brand new and are minimally handled before reaching the customer.

11.2 MINISTRY OF EDUCATION guarantees a positive experience through its dealings with the customer.

11.3 We guarantee our intentions are pure in providing the customer with tools that aim to encourage positive life experiences.

11.3 If a customer feels any of the above guarantees are not met, MINISTRY OF EDUCATION will provide a full refund of the purchase. 

11.4 MINISTRY OF EDUCATION believes in karma. If Clause 11.3 is enacted, it expects the customer to come from the purest of heart so not to invoke karmic laws for themselves in a negative way.

12.1 MINISTRY OF EDUCATION is dedicated to keeping your details private. Any information we collect in relation to you is kept strictly secured.

12.2 We do not pass on, sell or swap any of your personal details with anyone. We use this information to identify your orders, provide you with newsletters and to personalise your shopping experience with us.
